KOWLOON CRICKET CLUB GENERAL COMMITTEE CODE OF CONDUCT

1.

INTRODUCTION

1.1

In these Bye-laws, unless there is something in the subject or context inconsistent therewith:-

"The Club" means the Kowloon Cricket Club.

"The General Committee" means the General Committee of the Club for the time being.

"Members" means Life, Special Voting, Ordinary Voting, Corporate Nominee and Honorary Members. Updated 13th Oct 1999

"Members of the Section" means those who take or who have taken an active part in the sections activities.

"Subscribers" means Lady, Honorary Lady and Sporting Subscribers and the spouses of Members and Subscribers but excludes Junior Subscribers.

"Users of the Club" means any persons entitled to use the Club under these Bye-laws and includes Members, Subscribers, Junior Subscribers and Visitors and the children and guests of Members, Subscribers, Junior Subscribers, children and Visitors.

"The [Sports] Representative" means the representative of the [Sports] Section on the General Committee.

"The Secretary" means the Secretary of the Club for the time being.

Words importing the masculine gender include the feminine gender.

1.2

These Bye-laws are issued by the General Committee under Article 20 of the Articles of Association of the Club and may be altered, amended or deleted, at the discretion of the General Committee, subject to the overriding powers of the Members to set aside any Bye-laws through a Special Resolution at a General Meeting of the Members of the Club.

A printed copy of these Bye-laws together with a copy of the Memorandum and Articles of Association of the Club shall be sent to each Member, Subscriber and Junior Subscriber upon joining and shall be binding upon them, their spouse and their children.

The Memorandum and Articles of Association and these Bye-laws shall together form the basis for the relationship between the Club and Users of the Club. If any inconsistency should arise between the Memorandum and Articles of Association of the Club and these Bye-laws, the former shall take precedence.

Any question as to the interpretation of these Bye-laws shall be left to the discretion of the General Committee whose decision shall be final.

2.

 

GENERAL

2.1

The Club premises will normally open at 7:00am each day and close at midnight except on Fridays and Saturdays when the Club will normally close one hour after midnight provided always that the General Committee may vary these times on special occasions and at their discretion.

2.2

Members' and Subscribers' children under the age of 12 must be accompanied by their parent or by some other Member or Subscriber whilst on Club premises. On reaching the age of 12 children of Members or Subscribers will be issued, on request, with Dependants cards which will allow them to use the Club unaccompanied until they reach the age of 28. 2.3

On reaching the age of 23, application may be made to the General Committee for approval for a Member's child to continue to use the Club to the age of 28. If approved, the Member shall be liable for the payment of the child's monthly subscription and the debts and spending in the Club. The Member and the child shall both be subject to such rules and conditions that the General Committee may decide. Approved April GC 2010, (age reach 28) Feb 2013

2.4

Parents are responsible for the safety and conduct of their children whilst they are on Club premises and must monitor their children's behaviour to ensure they are in no physical danger and are not acting in an unruly manner.

2.5

No Subscription lists, raffles or canvassing of any kind will be allowed within the Club unless the prior consent of the General Committee has been obtained.

2.6

No animals shall be brought into the Club premises or grounds.

2.7

Users of the Club who break or damage Club property shall be liable to pay to the Club the cost of its replacement or repair.

2.8

Should there be cause for complaint the matter should be taken up with General Manager in the first instance or in writing to the Secretary. Club employees should not be reprimanded by any User of the Club. Effort should be made to resolve any problem verbally and in as amicable a manner as the situation allows.

2.9

Users of the Club are responsible for their property whilst they are on Club premises. The Club will not accept responsibility for any losses or damage no matter how incurred.

2.10

The giving of lessons for a fee or any form of a reward may only be carried out with the General Committee's prior approval. All payments must be via Club accounts and a percentage, as determined from time to time by the General Committee, may be deducted to cover expenses. Any unauthorized coaching etc. for a reward may result in the coach and the pupil being denied use of the facility involved.

2.11

Certain areas of the Club may be classified as non-smoking areas at the discretion of the General Committee.

2.12

For Members' children who have special needs and are not able to attend a membership interview due to their health, upon written request by the Member to the General Committee and subject to production of supporting documents and to the General Committee's discretion in each case, the following may apply:

(a)

The child does not have to attend an interview.

(b)

The child does not need to pay an entrance fee or monthly subscriptions.

(c)

The child may be allowed to bring in a helper who must be registered with the general office of the Club." Updated July 2010 GC Meeting

2.13

Servants of Users of the Club are not allowed into any part of the Club premises or grounds unless the prior consent of the General Manager has been obtained.

2.14

No radios, cassette players, CD players, portable televisions or musical instruments etc. shall be played in the Club premises or grounds without the prior consent of the General Committee unless the sound is transmitted through personal headphones. No mobile telephones shall be operated on the Club premises or grounds without the prior consent of the General Committee.

2.15

The use of roller skates, rollerblades, skateboards, scooters and all other types of recreational equipment on wheels are not permitted on club premises unless permission from management has been obtained. Approved February 2011 GC meeting

3.

 

GUEST

3.1

Members and Subscribers may introduce guests into the Club always provided that the same person may not enter the Club more than two times in any thirty day period as a guest.

3.2

The maximum number of guests that a Member or Subscriber may introduce at any one time is five. The number may be increased or reduced by the General Committee should circumstances so merit.

3.3

Any person introducing guests must accompany their guests whilst they are on Club premises and ensure that their guests' behaviour does not annoy other members.

3.4

Visitors, Junior Subscribers and dependant children may not introduce guests into the Club except that Junior Subscribers and dependant children over the age of 18 may bring one guest at any one time always provided that such guests are over the age of 18 and accompanied by the person bringing them.

3.5

Guests are not allowed to take part in any sport unless partnered or opposed by the person introducing the guests.

3.6

Ex-members removed under Articles 66 and 70 are not acceptable as guests.

3.7

Members or Subscribers who are not married may apply to introduce a nominated person as a Guest, and where appropriate their dependants as Guests, on an unrestricted basis. Members or Subscribers may be asked to supply any information as is deemed necessary to support their applications. Each such Guest may, at the sole discretion of the GC, be issued with a Guest card but only one application from a Member or Subscriber will be considered at any one time. Such Guests will be deemed to be users of the Club and are subject to the Articles and Bye-Laws of the Club where the context is deemed to be appropriate. The holder of a Guest card will be allowed to sign on the account of the Member or Subscriber introducing the Guest but the Member or Subscriber shall be responsible for any such expenditure. It is the Member's or Subscriber's responsibility to advise the Club when he/she no longer wishes his/her nomination to continue to hold a Guest card but regular changing of nomination will not be permitted.Updated April 2011 GC Meeting

3.8

Certain restrictions are applicable to guests when using the club's facilities. Please refer to individual section Bye-laws.

4.

GROUNDS

4.1

The Grounds Sub-Committee shall be chaired by the Captain of Cricket (who shall be the Cricket Representative) and shall comprise the Hockey Representative, a representative of the Soccer Section and up to three other people, one of whom shall be from the Cricket Sub-Committee.

4.2

The term "grounds" shall be deemed to mean the cricket field and the hockey and soccer pitches.

4.3

Reservations for any part of the grounds may be made only through the appropriate Representative who shall make all reservations through the General Manager who will maintain a diary for this purpose. The allocation of the main field for cricket, hockey or soccer must be agreed between the respective Representatives before fixture lists for the coming season are published. Should there be a disagreement the matter will be referred to the General Committee for a decision. League and Cup games will normally be given preference over practice or friendly matches.

4.4

The Captain of Cricket will normally rule on the suitability or otherwise of the grounds for play in consultation with the appropriate Representative. In the absence of the above a Committee Member in consultation with members of the section and the General Manager will decide.

4.5

The use of the cricket square for purposes other than cricket is strictly forbidden.

5.

CRICKET

5.1

The Cricket Sub-Committee shall consist of the Captain of Cricket, captains of all league teams and two other members one of whom shall act as secretary. The Sub Committee shall have power to co-opt other members of the section if considered necessary. Updated Oct 1999

5.2

The Captain of Cricket shall be the Club's representative at the Hong Kong Cricket Association.

5.3

A meeting of members of the Cricket Section shall be held annually, convened and presided over by the Captain of Cricket. The object of this meeting shall be to elect a Captain of Cricket for the ensuing year and to elect other team captains if considered desirable. The meeting shall also decide the number of teams to be entered in the leagues and the policy to be adopted in respect of these teams and shall discuss any other business relating to cricket generally. 5.4

Special meetings of members of the Cricket Section may be held at any time at the discretion of the Sub-Committee or at the request of at least 20 members provided that not less than 7 days' notice is given to members of the Section. Updated Oct 1999

5.5

For annual or special meetings a quorum shall be 20 members and any decisions made shall be on the basis of a simple majority. All voting will follow Article 87 of the Articles of Association of the Club pertaining to Special and Ordinary Voting Members. Updated Oct 1999

5.6

A reasonable amount of equipment, properly budgeted for, shall be provided by the Club for the use of all league teams.

5.7

Practice nets shall be available, subject to ground fitness, at such times and on such dates as laid down by the Cricket Sub-Committee provided the ground has not been reserved for other purposes.

5.8

Spiked boots are forbidden when playing on artificial surfaces and apart from the changing rooms and the balcony they must not be worn in the Club House.

5.9

Correct cricket attire must be worn when taking part in all league and representative matches.

5.10

Children under the age of sixteen are not permitted to use the nets whilst members are practising. The Cricket Sub-Committee may vary this rule in special circumstances.

5.11

Guest players shall be allowed to play only when Members or Subscribers are not available or to establish the guest's level of competence. Rule 3.5 will not apply in these cases.

6.

 

HOCKEY

6.1

The Hockey Sub-Committee shall consist of the Hockey Representative and the captains of the league teams and a Hockey Convenor. The Sub-Committee shall have the power to co-opt other members of the section if considered necessary. Updated Oct 1999

6.2

The Hockey Sub-Committee shall appoint a Club representative to the Hong Kong Hockey Association.

6.3

A meeting of members of the Hockey Section shall be held annually, convened and presided over by the Hockey Representative. The object of this meeting shall be to elect a Hockey Representative and a Hockey Convenor for the ensuing year. The meeting shall decide on the number of league teams to be entered for the following season, elect captains for such teams and discuss any other business relating to hockey generally. 6.4

Special meetings of members of the Hockey Section may be held at any time at the discretion of the Hockey Sub-Committee or at the request of at least 20 members provided that not less than 7 days' notice is given to members of the Section. Updated Oct 1999

6.5

For annual or special meetings a quorum shall be 20 members of the section and any decisions made shall be on the basis of a simple majority. Each member of the section will have one vote. Updated Oct 1999

6.6

The provision of equipment and clothing, with the exception of hockey balls and goalkeepers' equipment, shall be the responsibility of the players themselves. A small number of hockey sticks, however, shall be held by the Club for emergency use, players are not allowed to appear on the field without shirts.

6.7

Only the Hockey Representative, Hockey Convenor or team captains may give instructions regarding ground preparation for matches and these must be relayed to the grounds staff through the General Manager.

6.8

Any requests for the use of the hockey pitch by teams other than those of the Club must be forwarded through the Hockey Representative for agreement by the General Committee. In times of urgency the Hockey Representative may consult with the Hockey Convenor, Captain of Cricket or the General Manager.

6.9

Guest players shall be allowed to play only when Members or Subscribers are not available or to establish the guest's level of competence. Rule 3.5 will not apply in these cases.

7.

 

TENNIS

7.1

The Tennis Sub-Committee shall consist of the Tennis Representative, the Tennis Convenor, if not the Representative, and at least four other members. The Tennis Committee has the power to co-opt other members of the section. Updated Oct 1999

7.2

A meeting of members of the Tennis Section shall be held annually, convened and presided over by the Tennis Representative. The object of this meeting shall be to elect the Tennis Representative and the Tennis Convenor for the ensuing year. The meeting shall decide on the number of teams to be entered in the various leagues, elect captains and discuss any other business relating to tennis generally. Updated Oct 1999

7.3

Special meetings of the Tennis Section may be held at any time at the discretion of the Tennis Sub-Committee or at the request of at least 20 members provided that not less than 7 days' notice is given to members of the Section.

7.4

For annual or special meetings a quorum shall be 20 members and any decision shall be on the basis of a simple majority. Voting procedure will adopt the principle of one member one vote. In the absence of a member his/her spouse may attend and vote on his/her behalf. Updated Oct 1999

7.5

Unless otherwise determined by the General Committee or the Tennis Representative or the Tennis Convenor, the courts shall be available for use during the opening hours of the Club.

7.6

The Tennis Sub-Committee or the General Manager may close the courts, if in their opinion they are at any time not fit for play or for any other reason.

7.7

Apart from official Club and league matches, floodlit bookings and on occasions to be decided upon by the Tennis Sub-Committee, no reservations of courts are allowed.

7.8

Apart from official Club matches, or in the event when courts have been reserved for special occasions, no singles matches may be played when other courts are occupied and players are waiting to play. If, however, the singles matches were started prior to the arrival of waiting players, the set in progress may be concluded on the understanding that it shall not consist of more than 1 1 games. In all other instances when courts are occupied and players are waiting to play, the courts shall be vacated at the conclusion of the set, which shall not consist of more than 12 games. Players waiting shall be ready to play once the set in progress has terminated.

7.9

Proper tennis attire and tennis shoes shall be worn on the courts. Black soled tennis shoes are not permitted. Members of the Tennis Sub-Committee or the General Manager have the authority to debar anyone from playing who is not properly dressed or shod. Spectators are not allowed to enter court Nos. 1, 2 and 3. Any player or official who has to enter must be wearing flat, rubber soled shoes without heels.

7.10

Any complaints regarding the Marker or the condition of the courts shall be addressed to the General Manager.

7.11

There are no special rules with regard to the making up of foursomes, either men's doubles, ladies' doubles or mixed doubles. It is left to the players to make suitable and satisfactory arrangements. Under certain circumstances the Tennis Sub-Committee is authorized to make up foursomes.

7.12

Children are allowed to use the Courts subject to the following provisos:-

(a)

Proper tennis dress and tennis shoes must be worn.

(b)

Children under the age of 10 years are to be accompanied by, and under the supervision of, an adult.

(c)

On Saturday afternoons, Sundays and Public Holidays, children are not allowed to use a court when a Member or Subscriber is waiting to play and must vacate the court when it is required by Members or Subscribers.

7.13

No guests are allowed to play tennis on Saturdays, Sundays and Public Holidays without the prior approval of the Tennis Representative or the Tennis Convenor. A charge to be determined by the General Committee, per guest per day, will be levied against the account of the Member or Subscriber introducing the guest.

7.14

No smoking, food or drink, will be permitted on the courts. No smoking is not permitted at the tennis patio - viewing area under any circumstances Approved Dec GC 2010

7.15

Court No. 3 only will be used for coaching.

7.15(i)

Individual members who wish to have coaching are required to make the booking themselves and the tennis coach was not permitted to make the booking. Approved Mar 2010 GC meeting

7.16

The tennis courts can only be reserved between 6.00pm and 11:00pm in the winter and 7:00pm and 11:00pm in the summer by Members, Subscribers or Junior Subscribers on the following conditions:-

(a)

A court may be reserved for a 60 minute period between the above hours, with periods starting on the hour and not more than one period per evening shall be reserved by any one person.

(b)

Reservations cannot be made more than seven days in advance and only two reservations by any one person will be permitted in any seven day period.

(c)

A person may play on the court more than twice in a seven-day period, if the court has not been reserved by another Member or Subscriber or Junior Subscriber, but a reservation will not be permitted if it contravenes (b) above.

(d)

Reservations can be made by telephone or in person at the Club.

(e)

A court fee to be determined by the General Committee, in respect of each 60 minute period or part thereof will be charged to the account of the person making the booking.

(f)

A reservation may be cancelled without charge if at least 24 hours notice of the cancellation is given.

(g)

Unless a reservation is so cancelled the court fee shall remain chargeable to the account of the person making the reservation and an additional penalty to be. determined by the General Committee shall be charged.

(h)

The name of each player shall be recorded at the time of reservation.

(i)

The court shall be deemed to be vacant if play has not commenced within 10 minutes of the time reserved and, notwithstanding (g) above, the court may be used forthwith for the remainder of the period by any person present within the rules of court reservations.

8.

 

SQUASH

8.1

The Squash Sub-Committee shall consist of a committee of 5 and a Squash Representative who shall chair the Sub-Committee. The Committee is empowered to co-opt other members of the section. Updated Oct 1999

8.2

A meeting of members of the Squash Section shall be held annually, convened and presided over by the Squash Representative. The meeting shall elect a Representative for the ensuing year, decide on the number of teams to be entered in the Winter Squash League, elect convenors for such teams and discuss any other business relating to squash including the appointment of a Club representative to the HONG KONG SQUASH. 8.3

Special meetings of members of the Squash Section may be held at any time at the discretion of the Squash Sub-Committee or at the request of at least 20 members provided that not less than 7 days' notice is given to members of the Section. Updated Oct 1999

8.4

For annual or special meetings a quorum shall be 20 members and any decision shall be on the basis of a simple majority. Voting procedure will adopt the principle of one member one vote. Updated Oct 1999

8.5

The Club will supply squash balls for league matches but members are required to provide their own racquets.

8.6

The courts shall be open for play from 7:00am - 11:30pm daily. However, the General Committee may amend these hours, or close the courts.

8.7

Guests are permitted to use the courts at any time of any day up to and including the booking period commencing at 4:45pm providing they are playing with a Member or Subscriber.

8.8

A court fee, to be determined by the General Committee, in respect of each 45 minute period or part thereof will be charged to the account of the appropriate Member, Subscriber or Junior Subscriber.

8.9

Dress will consist of white, off-white or other suitable sports clothing and flat, rubber soled, non-marking sports shoes. Black-soled shoes are prohibited.

8.10

Courts can be reserved subject to the following conditions:-

(a)

Members, Subscribers and Junior Subscribers may reserve the court for 45 minute periods not more than one period per day, per account number or per registered HONG KONG SQUASH Player shall be reserved unless the prior consent of the Squash Sub-Committee or General Manager has been obtained.

(b)

Reservations can be made by telephone or in person at the Club.

(c)

The name of each player shall be recorded at the time of making each reservation.

(d)

Court reservations cannot be made more than seven days in advance.

(e)

No one person can make more than two reservations in any seven day period for the hours of noon - 2:00pm and 4:45pm - 7:45pm.

(f)

A reservation may be cancelled without charge if at least 24 hours notice of the cancellation is given.

(g)

Unless a reservation is so cancelled the court fee shall remain chargeable to the account of the person making the reservation and an additional penalty, as determined by the General Committee shall be charged.

(h)

The court shall be deemed to be vacant if play has not commenced within 10 minutes of the time reserved and the court may be booked forthwith for the remainder of the period by any other person present who is entitled to do so.

8.11

The squash complex is a non-smoking area and anyone entering this area must refrain from smoking.

9.

 

LAWN BOWLS

9.1

The Lawn Bowls Sub-Committee shall consist of the Lawn Bowls Representative and captains of the league teams. They shall have the power to co-opt other members of the section. Updated Oct 1999

9.2

The Lawn Bowls Sub-Committee shall appoint a Club representative to the Hong Kong Lawn Bowls Association.

9.3

A meeting of the members of the Lawn Bowls Section of the Club shall be held annually, convened and presided over by the Lawn Bowls Representative. The meeting shall elect a Representative for the ensuing year, decide on the number of teams to be entered in the coming league, elect captains and discuss any other business relating to lawn bowls.

9.4

Special meetings of members of the Lawn Bowls section may be held at any time at the discretion of the Lawn Bowls Sub-Committee or at the request of at least 20 members provided that not less than 7 days' notice is given to members of the Section. Updated Oct 1999

9.5

For annual or special meetings a quorum shall be 20 members of the section and any decisions made shall be on the basis of a simple majority. Each member of the section will have one vote. Updated Oct 1999

9.6

The bowling greens shall be open for play on such days and at such times as may be determined by the Lawn Bowls Sub-Committee. They may also be closed for play upon such days as the Lawn Bowls Sub-Committee may decide for the purpose of preserving the greens. In case of inclement weather and in the absence of any member of the Lawn Bowls Sub-Committee or General Committee, the greens may be closed at the discretion of the General Manager after consultation with the grounds staff.

9.7

The greens or any part thereof may be reserved for any particular lawn bowls game or games, or for league practice at the discretion of the Lawn Bowls Sub-Committee. Special matches other than Club and National tournaments shall be subject to the prior approval of the General Committee.

9.8

Club players participating in League matches and National tournaments shall be dressed in the manner stipulated by the Rules of the Hong Kong Lawn Bowls Association. Players participating in Club competitions and friendly games may be clad in any modest and comfortable attire but must wear heel-less shoes.

9.9

Mobile phones may be used on silent mode in the surrounding areas but NOT on the green surface while a game or practice is in progress. Approved Oct 2010 GC meeting

9.10

Smoking is only allowed in the surrounding area but NOT on the playing surface of the lawn bowls greens and the covered area of the bar. Approved Oct 2010 GC

9.11

Any member of the Lawn Bowls Sub-Committee may debar any person from further participation whether in practice or in a match should he or she be found to be causing damage to the greens in any way.

10.

 

TEN PIN BOWLING

10.1

Hours of play will be from 10:30am to 11:00pm each day. After 10:30pm the Controller shall decide if time permits to book further games.

10.2

Charges for games will be as indicated on the charge sheet on the notice board and may be varied from time to time at the discretion of the General Committee.

10.3

Each person will be allowed to book not more than three games and must personally make the booking. If the person who has booked the lane is not present when the lane becomes available the booking will be cancelled and the lane will be allocated to the next name on the booking list. Bookings will only be accepted by the Controller.

10.4

Children under 14 years must be accompanied by a Member or Subscriber.

10.5

No eating, smoking or drinking on the approaches to the lanes is allowed.

10.6

Bowling shoes must be worn by all persons before stepping on the approaches to the lanes. Shoes will be supplied free of charge.

10.7

All Emergency Exits are to remain closed at all times and used only in the case of fire or other emergency.

10.8

The Controller may bar from playing any person who in the Controller's opinion is damaging the playing surface of the alley.

11.

 

SNOOKER ROOM

11.1

A meeting of members of the Snooker Section of the Club shall be held annually and presided over by the Snooker Convenor. The meeting shall elect a Convenor and at least three Sub-Committee Members for the coming year and discuss any other business relating to snooker and billiards.

11.2

Special meetings of the Snooker Section may be held at the discretion of the Snooker Sub-Committee or at the request of at least 20 members provided that not less than 7 days notice is given to members of the Section.

11.3

For annual or special meetings a quorum shall consist of 20 members and any decision shall be on the basis of a simple majority.

11.4

The snooker room will open during normal Club hours.

11.5

Any Member or Subscriber waiting to play shall place their initials on the board provided for that purpose. No Member or Subscriber may book more than one table at a time and when their turn to play comes their initials shall be removed from the board by the Marker.

11.6

Any Member or Subscriber having booked a table and is absent from the Room when the table becomes vacant and cannot be found immediately, shall have their initials removed from the board by the Marker.

11.7

No game of billiards shall exceed 101 points or 45 minutes whichever is the least.

11.8

Practice is permissible at any time when a table is vacant and is not required for an ordinary game.

11.9

The officially published and posted General Rules of Billiards and Snooker shall apply.

11.10

No player shall smoke over the tables.

11.11

Dependant children and Junior Subscribers under the age of 18 are not permitted in the Snooker Room.

11.12

Guests are not permitted to start playing in any game between 5:00pm and 8:00pm weekdays or 2:00pm and 8:00pm on Saturdays, Sundays and Public Holidays.

11.13

Junior Subscribers and dependant children over the age of 18 are:-

(a)

Not allowed to play between 5:00pm and 7:00pm on weekdays or 2:00pm and 7:00pm on Saturdays, Sundays or Public Holidays.

(b)

Not permitted to play at any time if Members or Subscribers are waiting to play but will be allowed to complete any games in progress.

11.14

No food is allowed in the Snooker Room other than as may be arranged on special occasions.

11.15

A table fee, as determined by the General Committee may be charged.

11.16

In the absence of the Convenor or any members of the Sub-Committee, the enforcement of these Bye-laws shall be referred to the General Manager.

12.

 

RACE BOXES

12.1

The Race Boxes at Happy Valley and at Shatin allocated to the Club are reserved for the use of Members, Subscribers and their bona fide guests, who have purchased a Guest Badge.

12.2

A meeting of members of the Racing Section of the Club shall be held annually and presided over by the Race Box Convenor. The meeting shall elect a Convenor and Sub-Committee for the coming year and discuss any other business relating to the Race Boxes.

12.3

Special meetings of the Racing Section may be held at the discretion of the Race Box Sub-Committee or at the request of at least 12 members provided that not less than 7 days notice is given to members of the Section.

12.4

For annual or special meetings a quorum shall consist of 12 Members and any decision shall be on the basis of a simple majority.

12.5

A Race Box badge which will be valid for the current season will be issued one to each Member or Subscriber on application to the General Manager and payment of the appropriate fee.

12.6

Members and Subscribers may invite guests to either Race Box provided that space is available.

12.7

Guest Badges will be obtainable only at the Race Box on each race meeting at a price as determined by the General Committee at the beginning of each racing season. The sale of Guests Badges will be subject to an overall limit per race meeting as the Committee may from time to time determine. Guests must be accompanied by their hosts and the names of the guests must be entered in the Guests Book. Members are fully responsible for their guests.

12.8

The Race Box Convenor, Sub-Committee or Duty Captain will exercise such supervision as may be necessary to ensure that only those Members, Subscribers and their invited guests who are in possession of valid badges are using the Race Box. Badges must be worn continuously throughout each race meeting in such a manner as to be readily identifiable. Persons without valid badges may be challenged by a member of the Box Sub-Committee or Club staff on duty.

12.9

Members' and Guest Badges are not transferable.

12.10

The loss of a Member's Badge must be reported to the Race Box Convenor, member of the Sub-Committee or the duty captain.

12.11

Casual visitors to the box may remain for not more than one race, and in each case, the person whom the visitor has come to see should inform the Convenor or Sub Committee member of the presence of such visitor. If this privilege is abused, the Member or Subscriber concerned will be required to buy a Guest Badge for their visitor and may be denied further use of the Club Box.

12.12

No employee of the Club shall be used to place bets or collect dividends.

12.13

tables in either Box can be reserved in advance upon application to the General Manager.

12.14

The Sub-Committee and/or Box Convenor will normally adjudicate in matters of dispute and give guidance in respect of the use and privileges of the Race Box. Any appeal against their decision must be made in writing to the General Committee.

12.15

All matters not specifically provided for under the Bye-laws shall be subject to the Rules and Regulations and Bye-laws of the Club.

13.

 

SWIMMING POOL

13.1

The large pool shall be known as the adult's pool. The two small pools shall be known as the children's pool and toddler's pool. The latter is reserved for children of 3 years of age and under. The area within the fenced compound around the pools, including the building housing the pool changing rooms, shall be known as the pool area.

13.2

The pool area shall be open from 7:00am to 10:00pm daily during the swimming season.. On Monday morning the pool will close between 9:00AM - 12:00PM for cleaning. If Monday is a public holiday; then cleaning shall take place the day following the Public Holiday. The General Committee shall determine variations to these times and the swimming season.

13.3

Children under 14 years are only allowed within the pool area and to swim within the pool area when a Member or Subscriber specifically responsible for their welfare is in attendance in the pool area.

13.4

Members, Subscribers over the age of 18, Junior Subscribers and dependant children may bring guests, including children, into the pool area subject to the following:-

(a)

the guest rules in Section 3 of these Bye-laws. And

(b)

on Saturdays, Sundays and Public Holidays guests shall only be permitted in the pool area if they have a guest pass. Guest passes are issued subject to management discretion and Members must contact the club prior to bringing guests to the pool on the above mentioned times. Only 10 such passes will be issued on any one day and must be handed to the Pool Receptionist on entering the pool area and the required fee will be charged. Guest passes are not required on weekdays.

A fee, to be determined by the General Committee, will be charged to the account of the person introducing the guest, for each guest introduced to the pool area. The person introducing guests must remain in the pool area with their guests and be responsible for their conduct. Guests shall be bound by these Bye-laws and must conduct themselves in such a manner so as not to inconvenience or cause annoyance to other users of the pool area. This fee will be charged regardless whether the guest swims or not and how long the guest remains in the pool area. Any Member found introducing guests into the pool area and then leaving the guests alone maybe be required to explain why to the discipline committee.

13.5

No person with any contagious skin ailment or disease may enter the pool area.

13.6

Membership cards must be available for inspection on entering the pool area. Failure to produce membership cards may result in entrance to the swimming pool area being denied. Should any dispute arise as to the eligibility of persons to enter the swimming pool area the General Manager or any member of the Swimming Pool Sub-Committee will arbitrate.

13.7

The adult's pool is strictly reserved for adults, children over the age of 12, and younger children who have passed the requisite test of swimming two lengths of the adult's pool - unaided. Members of the pool subcommittee or lifeguards on duty or Club Management shall adjudicate the test as deemed by the General Committee The adjudicator's decision shall be final. A badge shall be issued to each child passing the test and thereafter this badge shall be worn on all occasions when the child enters the adult's pool. Children under the age of 12 who are guests and wish to swim in the adult's pool must also take the test and will be issued with a day badge if they pass. Day badges will be issued on the signature of the person introducing the child and must be returned on leaving the pool area for the day - the Member or Subscriber introducing the child shall be charged an amount to be determined by the General Committee if the badge is not returned. Tests for day badges shall be adjudicated by a member of the Swimming Pool Sub-Committee or Club management or by the Life Guard on duty. The adjudicator's decision shall be final. If the child has passed the test and is not wearing the badge, a day badge shall be issued for a nominal fee as decided by the General Committee.

13.8

In order that the ability to swim may be attained, practice for children shall be permitted in the adult's pool under the supervision of a Member or Subscriber who must be in the pool and be responsible for the safety of the child.

13.9

The children's pool and toddler's pool are strictly reserved for younger children. Adults are only permitted to enter these pools when teaching non-swimmers, or for the care of babies and toddlers. The playing of boisterous games by older children and the throwing of balls etc. is not allowed in these pools when other children wish to use these pools.

13.10

Children or adults may only use floatation aids for the purpose of learning to swim except that kickboards are not permitted in the adult's pool. Kick boards are permitted for training purposes between 7:00AM - 10:00AM and 7:00PM - 10:00PM for training purposes.

13.11

Bathers must use the showers provided before entering the pool and must change in the changing rooms at the pool complex.

13.12

Smoking, drinking or eating while sitting on the edge of the all pools is prohibited.

13.13

For safety reasons, all swimmers must follow the instructions of the Pool Supervisor or Life Guards on Duty. Failure to follow instructions of the Pool supervisor or Life Guards on duty may result in expulsion from the pool area. Management's decision on the matter shall be final

13.13a

Emergency procedures:
If the life guard blows his whistle once-ALL ACTIVITIES IN THE POOL MUST CEASE and
If the life guard blows his whistle three times, all swimmers must leave the pool immediately and then wait for instructions from the Life guards on Duty

13.13b

Diving or jumping must be at the deep end only. For safety reasons, swimmers using the diving board should avoid diving to the side of the diving board. Children under 12 using the diving board must be under the supervision of their parents.

13.14

All persons using the pool area are reminded that the Club cannot be held responsible for any accidents or injury sustained in the pool area.

13.15

Valuables should not be left in the changing rooms. The Club will not be responsible for any loss of property.

13.16

The throwing of coins or other objects into any of the pools is not allowed neither is the throwing of balls, frisbees etc. within the pool area except on special occasions as determined by the Swimming Pool Sub-Committee and Club Management

13.17

All persons using the pool may not pass through the Club premises clad only in their swimsuits and must use the rooms provided at the pool for changing purposes.

13.18

Children under the age of 14 are not allowed on the roof bathing area

13.19

A copy of these rules are on display at the pool entrance

13.20

Boys over the age of 5 are not permitted in the Ladies changing room and girls over the age of 5 are not permitted in the Men's changing room.

13.21

Balls are not permitted on the roof of the building housing the changing room.

13.22

The Club provides sun-beds for the convenience of users of the pool area. The number of sun-beds is limited by the available space and reserving sun-beds for people not in the pool area is not permitted. The Club also provides mattresses for the sub-beds these are to be used with the sun-beds only and must not be laid on the ground.

13.23

The Club provides towels for the convenience of users of the pool area. Restrictions may be placed on the issue of towels. Towels must be signed for and be returned on leaving the pool area for the day. A charge to be determined by the General Committee shall be levied for any towels that are not returned.

13.24a

As stated in byelaw 2.13, Servants of Users of the Club are not allowed into any part of the Club premises or grounds unless the prior consent of the General Manager has been obtained.

13.24b

When, special permission has been obtained for the guardian to be in attendance at the pool, the guardian must display the specially prepared pass.

13.25

As stated in 2.3 any guardian brings a child to a class must register at the reception and receive a guardian pass, which must be worn. The pass must be returned upon leaving. Guardians after taking the child to the designated activity may use the seating area outside the playroom, which on a trial basis has been, designated a guardian waiting area. This may only be used on Monday - Friday's up to 6:00PM and up to 1:00PM on Saturdays, excluding public holidays.

All decisions by Management are final

14.

 

FOOTBALL

14.1

The Football Section being an organized sports section of the Club shall have a Sub Committee comprising a Chairman, Secretary and a Manager/Coach for each team. Other members of the section may be co-opted. Updated Oct 1999

14.2

A general meeting of members of the Soccer Section shall be held annually and convened and presided over by the Chairman. Besides the election of the section Sub-Committee the meeting shall decide on the number of teams to be organized for the following season and discuss any other business relating to Football at the Club. 14.3

Special meetings of the Football Section may be held at any time at the discretion of the Sub-Committee or at the request of at least 20 members provided that not less than 7 days notice is given to members. Updated Oct 1999

14.4

annual or special meetings a quorum shall be 20 members of the section and any decision shall be made on the basis of a simple majority. Each member of the section will have one vote. Updated Oct 1999

14.5

A reasonable amount of playing kit, balls and other Football accessories, properly budgeted for, shall be provided by the Club for the use of the Section.

14.6

Guest players shall be allowed to join in Football activities, including playing for the Club, only when Members or Subscribers are not available or to establish a potential member's level of competence and ability. Club rule 3.5 will not apply in these cases.

15.

CAR PARK REGULATIONS

15.1

Members and Subscribers may park their own vehicles in the car park provided they have permits for the vehicles. Such permits are either:-

15.1.1

Parking Labels which allow Members and Subscribers to park their vehicle in the car park provided they are within the Club premises. Parking Labels are issued for a calendar year. A Parking Label may cover more than one vehicle but only one of the vehicles may be parked at any one time.

15.1.2

Secondary Parking Labels which allow Members and Subscribers to park a second vehicle in the car park from Monday to Friday provided they are within the Club premises.

15.1.3

Diamond Labels which allow Members and Subscribers to park their vehicle in the car park throughout the day and overnight from Monday to 12 noon on Saturday without being in the Club premises. Diamond Labels are issued for a calendar month and may cover more than one vehicle. The General Committee shall determine the number of Diamond Labels issued monthly.

15.2

The fees for Parking Labels and Diamond Labels (hereinafter collectively referred to as Permits) and any other charges shall be determined by the General Committee.

15.3

In order to obtain a Permit the Member or Subscriber must produce:-

15.3.1

Club Membership Card

15.3.2

Valid Hong Kong Driving Licence

13.3.3

Owners vehicle registration book(s) or a company vehicle registration book(s) (or a photocopy if driving a company vehicle) together with a letter from the Company authorizing the Member or Subscriber to drive the car.

15.4

Permits will not be replaced except with the approval of the General Committee and at a cost to be determined by the General Committee.

15.5

Each Permit will indicate thereon the vehicle registration number(s) for which it was issued. Any unauthorised amendment/alteration on a Permit will be dealt with by the General Committee.

15.6

Permits must be permanently displayed on the windscreen at all times whilst the vehicle is in the car park.

15.7

Vehicles will only be permitted to enter the car park after the car park attendant is satisfied that the vehicle registration number and number on the Permit tally.

15.8

The Club must be notified of any change in vehicle or registration numbers, with the immediate return of the superseded Permit. No charge shall be made for a replacement Permit in such a case.

15.9

Members and Subscribers resigning from the Club must return their permits.

15.9.1

Members and Subscribers whose permits without violations returned to the Club may receive a pro-rata rebate.

15.10

The car park will be open during normal Club Hours. Overnight parking will not normally be allowed for vehicles with a Parking Label save that Members or Subscribers may give notice to the Bar staff of their intention to leave the vehicle parked overnight as they consider it unsafe from them to drive. Members or Subscribers who fail to give such notice and leave their vehicle parked overnight will have their account debited with a charge to be determined by the General Committee. Members and Subscribers may appeal in writing to the General Committee against this charge and, should the General Committee at its absolute discretion accept the explanation offered, the account will be then credited with the amount debited.

15.11

Cars and motorcycles may only be parked in designated parking spaces. Double parking and obstruction of driveways or exits will not normally be permitted.

15.12

Vehicles will not be permitted to enter the car park when the "Car Park Full" sign is displayed.

15.13

Chauffeur driven cars with valid permits will be permitted entry to the car park if the Member is in the car or the Club.

15.14

Visiting teams playing against the Club on the Club premises may occupy one parking space per team provided the captain of the visiting side makes prior arrangements with the General Manager.

15.15

Members and Subscribers may arrange for their guests to park vehicles in the car park during weekdays and on Saturday and Sunday evenings by application in advance to the General Manager provided that the Members or Subscribers and their guests are using the Club facilities and that the quota of Guest Parking Labels has not been taken up. A Guest Parking Label will be issued when the guest's vehicle enters the car park and must be returned when the vehicle leaves the car park. The number of guest labels available shall be determined by the General Committee.

15.16

Members or Subscribers failing to comply with any of these regulations and who are unable to provide a satisfactory explanation to the General Committee may have their account debited with a charge or may have their Permit withdrawn for a period as determined by the General Committee at it's sole discretion.

16.

 

BARS

16.1

The main bar will normally be open from noon on weekdays and from 10:00am on Saturdays, Sundays and Public Holidays and will normally close at midnight but shall close one hour after midnight on Saturdays and Sundays. Other bars will, at the discretion of the General Committee or the General Manager be opened to meet the demand for services. Opening and closing times may be varied.

16.2

No one under the age of 18 years is allowed to enter the main bar or the bar lounge except on special occasions determined by the General Committee.

16.3

Drinks will normally only be served in the main bar, restaurant, coffee shop and snooker room. Waiter service will normally only be available in the restaurant or coffee shop.

16.4

No User of the Club may bring drink into the club premises.

16.5

Dress may be casual but anyone participating in energetic sports will be expected to shower and change subsequent to any game before entering the bar at any time.

17.

 

CATERING

17.1

Provided always that the opening hours may be varied by the General Committee, the restaurant will be open between noon and 3:00pm on weekdays and between 7:00pm and 12:00pm every evening, the coffee shop will be open from 7:00am to 10:00pm every day and the food outlet at the pool area will be open between 10:00am and 7:00pm on weekdays and between 10:00am and 8:00pm on weekends and holidays.

17.2

Waiter service will be provided in the restaurant, coffee shop, balcony, the Race Boxes and other areas at the discretion of the General Manager. The pool area will be self service. Food is not allowed in the snooker room.

17.3

Chits will be presented for signature at the end of meals taken in the restaurant, coffee shop and race box. For all other orders chits must be signed as the order is placed.

17.4

The restaurant is normally restricted to adults and accompanied children aged 12 or over. Children under the age of 18 must be accompanied by an adult. Normal guest rules will apply.

17.5

A respectable standard of dress will be maintained at all times. Sportswear, tracksuits, shorts and flip flops are not acceptable in the restaurant. In the coffee shop dress may be casual within the normal limits of what is acceptable in a coffee shop atmosphere. Sportswear prior to participating in a sport is acceptable but participants of active sports subsequent to playing will be expected to shower and change before entering the coffee shop. Exceptions may be made to accommodate players participating in official matches at the Club providing there is no risk of damage to the furnishings. The General Manager, Food & Beverage Manager and the Head Waiter have the right to exclude anyone not suitably dressed.

17.6

Furniture in the restaurants must not be rearranged except by the catering staff and with the General Manager's approval.

17.7

The Food & Beverage Manager may accept table bookings for the restaurant at his discretion. No reservations will be accepted for the coffee shop other than on approved occasions e.g. Christmas Day, special functions.

17.8

No User of the Club shall bring food for consumption into the Club premises or grounds.

17.9

DRESS CODE POLICY FOR KCC F&B OUTLETS - approved Aug 2010 GC Meeting - not vetted by the lawyer as yet.

17.10

Standard Regulations for all F&B indoor outlets

(i)

Members are requested to ensure that their families and their guests are aware of and respect the dress code policy.

(ii)

Appropriate footwear is to be worn in all indoor F&B outlets

(iii)

Persons who have participated in sports must shower and change before entering F&B outlets

(iv)

The use of towels in F&B outlets is not permitted.

(v)

Gentlemen may not wear sleeveless shirts or vest in F&B outlets.

(vi)

Swimming costumes will not be admitted.

(vii)

The wearing of Caps/Hats is not permitted unless prior permission has been obtained from management.

(viii)

Management decision will be final.

17.11

Coffee shop and Chinese Restaurant

(i)

Will follow standard regulations of F&B outlets

17.12

Main Bar

(i)

Will follow standard regulations of F&B outlets

17.13

Pavilion

(i)

Will follow standard regulations of F&B outlets.

(ii)

After 7 pm, patrons are requested to dress 'smart casual'*.

*Smart casual includes Trousers, dress shorts, shirts with collar, Jean/denim. Collarless T-shirts, tracksuits, flip-flop foot wear are not acceptable.

17.14

Restaurant/Grill Room

(i)

Will follow standard regulations of F&B outlets.

(ii)

A conservative standard of dress is required at all times.

(iii)

For Gentlemen-., Trousers , shirts with collar, (Dress shorts and denim/jeans are allowed during lunch service)

(iv)

Ladies- to dress as appropriately for fine dining.

(v)

For Ladies and Gentlemen: The following are not permitted: denim/jeans, shorts, shoes for sport activities, flip-flop.

17.15

Swimming Pool/Snack Bar

(i)

The wearing of bathing costumes and any swim wear is restricted to the Swimming Pool Complex

18.

SPORTING SUBSCRIBERS

18.1

On becoming a Sporting Subscriber, a Sporting Subscriber shall sign an undertaking on sporting participation ("the Undertaking") in the form as determined by the General Committee.

18.2

A Sporting Subscriber shall comply with the terms of the Undertaking. If the Sporting Subscriber repeatedly falls or refuses to comply with the terms of the Undertaking without reasonable explanation, the Sports Representative of the Sporting Subscriber's Sports Section, may in his/her discretion, suspend the Sporting Subscriber from participating in his/her chosen sport for the Club. The Sports Representative shall have the discretion to determine the period of suspension ("the Suspension").

18.3

The Sports Representative shall notify the Sporting Subscriber of the Suspension in writing ('the Notice') and deliver a copy of the Notice to the General Committee forthwith. The date of the Notice shall be the commencement date of the Suspension.

18.4

The General Committee has full discretion in sanctioning Sporting Subscribers who are in breach of the Undertaking in a manner as the General Committee deems fit without restriction of its power to revoke a defaulting Sporting Subscriber's subscribership.

18.5

The General Committee shall keep a current register of Sporting Subscribers and shall regularly review the register.

18.6

After the duration of [3] years from the date of admission to the Club as a Sporting Subscriber, a Sporting Subscriber may apply to be admitted as an Ordinary Voting Member by completing a membership application form and sending the same to The Secretary. A Sporting Subscriber who is successful in applying to become an Ordinary Voting Member shall pay the membership fee current at the time.

19.

 

MEMBERSHIP AND SOCIETY MEETINGS - Approved February 2010

19.1

Every society shall elect a committee comprising a Chairman, Secretary and a minimum of 3 other members.

19.2

A meeting of the society, to which all members of the society and the General Committee shall be invited to attend, shall be held within each calendar year presided over by the Chairman or in his or her absence, another member of the committee.

19.3

The business to be conducted at the meeting shall include electing the committee and discussing other matters relevant to the operation of the society. This shall include any fees or charges to be levied.

19.4

The Secretary of the society shall maintain a register of members. The register shall be open for inspection by any member of the society or General Committee.

19.5

To be eligible to participate and vote at a meeting of the society, a member's name must have been entered on the membership register no later than 14 days prior to the date of the meeting in question.

19.6

The quorum for a meeting shall be 10 members or 10% of the total membership of the society, whichever is the greater.

19.7

Each society shall propose the qualifications for membership of their society to the General Committee for approval.

19.8

Decisions of the society's meetings shall be determined on the basis of a simple majority with each member attending entitled to one vote.

19.9

The notice convening a meeting of the society shall be given to all members of the society and the Club's General Manager at least 14 days prior to the date of the meeting.

19.10

Special meetings of the society, open to all members of the society and the General Committee, may be convened at the discretion of the committee or at the request of at least 10 members. Rule 9 is to apply, in particular.

19.11

Unless otherwise stated the byelaws of the sections shall prevail where conflict of the rules with the societies herein arises.

20.

 

CHANGING ROOMS

20.1

Belongings and valuables

Users of the Club are reminded not to leave their belongings and valuables unattended in the Club's changing rooms. Unattended belongings and valuables are left at Users' own risk. Please note Bye-law 2.9 which states "Users of the Club are responsible for their property whilst they are on Club premises. The Club will not accept responsibility for any losses or damage no matter how incurred".

20.2

General
The changing room facilities are subject to the following rules as to use:-

(a)

Boys aged 5 or above are not allowed to be in the Ladies' changing room. Approved GC Feb 2013

(b)

Girls aged 5 or above are not allowed to be in the Men's changing room. Approved GC Feb 2013

(c)

Mobile phones should be turned to silent or vibrate mode and not be answered inside the changing rooms.

(d)

Spitting is strictly prohibited.

(e)

Glass containers or glassware shall not be brought into or used in the change rooms

(f)

Items of food shall not be consumed in the change rooms

(g)

The changing room facilities are for showering and changing only. Hair, body , facial, and skin treatments are not permitted in any part of the change rooms

(h)

Hair dryers are strictly for hair drying only. Drying clothing or other parts of the body is prohibited.

(i)

Clothes shall not be washed in the hand basins.

(j)

Users are reminded to avoid throwing talcum powder over the changing benches or floors. Leaving talcum powder on floors may cause accident.

20.3

Use of towels in the changing rooms

(a)

Users are requested to take one bath towel at a time.

(b)

Bath towels should not be placed on the floor for hygiene purposes and shall be placed in the appropriate towel bins after use.

20.4

Use of daily lockers

(a)

Users of the Club (which includes guests) using the daily lockers should empty the locker after use. The Club's management reserves the right to empty any locker that is not surrendered at the end of the day.

20.5

Use of Jacuzzi and Sauna

(a)

Children under 12 are not permitted to use the Jacuzzi or Sauna.

(b)

Users are required to shower before entering the Jacuzzi or Sauna.

(c)

Sportswear is not permitted to be worn in the Jacuzzi or Sauna, only swimwear is permitted.

(d)

The drying of clothes, tennis balls or other items is not permitted in the Sauna.

(e)

Use of the Jacuzzi is for relaxation and not for beauty treatments, skin treatments or any other purpose.

20.6

Members and Subscribers' responsibility for their guests' behaviour.

Members and Subscribers are responsible for their guests' behaviour. Any Member or Subscriber failing to comply with these bye-laws or allowing their guests to do so may be subject to disciplinary action.

FITNESS CENTRE GC approved August 2010 GC meeting

21.1

General - management and use

(a)

This Bye-law relates to the proper management of the Club's fitness centre ("the Fitness Centre"), safety, hygiene, and courtesy of users towards each other.

(b)

Use of the Fitness Centre is limited to Members, Subscribers, Junior Subscribers and Dependants of Members and Subscribers, subject to a minimum age limitation. Guests are not permitted under any circumstances to use the facility.

(c)

All users of the Fitness Centre ("Users") must have completed the gym orientation programme before they are allowed to use the facility.

(d)

Users of the Fitness Centre should always be aware of the dangers posed by the incorrect use of equipment and should learn to use the same in a manner appropriate to their physical ability and medical condition.

21.2

The Fitness Centre is subject to the following rules as to use:-

(a)

All Users must sign the Attendance Record on entry to the Fitness Centre.

(b)

Guests are not permitted to use the Fitness Centre.

(c)

Users are not permitted in the Fitness Centre office without permission.

(d)

All new users must complete a gym orientation programme before using the facility.

(e)

Users 16 and above are permitted to use the Fitness Centre. However, children of 15 years may use the Fitness Centre (except between 6:00 p.m. and 8:00 p.m. Monday to Friday) provided they have completed a full orientation of the equipment and have produced a signed letter of permission from a parent.

(f)

All Users must at all times follow the reasonable directions of the Staff in relation to their use of the Fitness Centre, including but not limited to:

return of free weights to correct racks after use,

use of security clips on any weights,

use of free weights when using aerobic machines,

placing of personal belongings,

stretching/resting at or by machines between sets, etc.

(g)

All Users of the Fitness Centre must be appropriately attired in sportswear and sports shoes.

(h)

No User is permitted to use any aerobic machine (treadmills, steppers, cross trainers, bikes, rowers, etc.) for more than 30 minutes, including cool down time.

(i)

No free weights or other equipment are to be taken out of the Fitness Centre.

(j)

Users of machines and equipment must wipe them down with a towel after use.

(k)

Towels supplied in the Fitness Centre are to be used only in the Fitness Centre and must not be removed from there They are to be placed in the bin provided after use.

(l)

Glassware and food consumption are not permitted in the Fitness Centre.

(m)

Photography and videography is not permitted within the confines of the Fitness Centre. Mobile phones must be kept on silent mode and not answered inside the Fitness Centre.

21.3

Liability for use of the Fitness Centre

Members are reminded that use of the Fitness Centre is at their own risk and that the Club will not be responsible for any accident or injury whatsoever, however caused. All new users must undertake an orientation session before using the Fitness Centre equipment. If despite having had an orientation session, Users are subsequently not sure about how to use particular items of Fitness Centre equipment, they should ask the Staff for advice and assistance before using those items of equipment.

KOWLOON CRICKET CLUB GENERAL COMMITTEE CODE OF CONDUCT - Approved March 2010 GC

PURPOSE

The purpose of this Code of Conduct is to provide General Committee Members with clear guidelines as to the standard of behaviour, responsibilities and best practice in fulfilling their obligations to the members and staff of the Club.

A General Committee member must observe the Club's Code of Conduct whenever he:

(a)

Conducts the business of the Club;

(b)

Conducts the business of the office to which he/she has been elected or appointed; or

(c)

Acts as a representative of the Club.

ORGANISATIONAL VALUES

ACCOUNTABILITY
Everything the Club does must be able to stand the test of scrutiny by members, stakeholders and Government agencies.

INTEGRITY AND HONESTY
These will be the hallmarks of all conduct when dealing with members, General Committee colleagues, staff and all other stakeholders inside or outside the Club.

TRANSPARENCY
The Club's General Committee seeks to maintain an appropriate atmosphere of openness whilst acknowledging the need for confidentiality in sensitive issues involving finances and personal privacy.

COMMITMENT
General Committee Members must be committed to the Club and its objectives.

COMPETENCE
General Committee members are expected to develop competence in their role. They must keep themselves aware of issues affecting the Club and its objectives. Although General Committee members need to work closely with the Club's General Manager and his staff, they must respect their roles and not micromanage their work. Improving quality of service and continuing to improve finances are key aims.

THE LEGAL FRAMEWORK
General Committee members must act in accordance with all the applicable law, in particular the Memorandum and Articles of Association and Bye-Laws of the Club.

PREPARATION AND ATTENDANCE
General Committee Members must spend an appropriate amount of time reading papers and preparing for forthcoming meetings.

DECISION-MAKING
General Committee Members must act and make decisions only in the best interests of the Club and its members. Where General Committee Members lack specific knowledge or experience, they should always seek advice.

AUTHORITY
The General Committee has authority to form sub-committees to assist in its work. However, decisions made by sub-committees on matters coming within their province need to be approved by the General Committee before becoming final. All decisions made or approved by the General Committee are made collectively, and General Committee members are jointly and severally responsible for them.

CORPORATE RESPONSIBILITY
General Committee Members are expected to support any General Committee decisions outside of Committee meetings. General Committee decisions should be communicated to members and staff (where relevant) in a unified nature. Matters of a confidential manner must remain so outside the confines of the Committee. General Committee members must not bring themselves or the Club into disrepute.

BENEFITS
General Committee Members must not receive any financial or other benefit as a result of their position that is not specifically authorized. General Committee Members must report the offer of any gifts or hospitality offered in connection with their General Committee responsibilities to the General Committee. All General Committee members and members of sub-committees are required to sign a declaration that they are not receiving any income from business with the Club.

CONFLICTS OF INTERESTS
General Committee Members must not exert any influence based on their connection with the Club to obtain preferential treatment for themselves or others. Any conflict of interest must be declared at the earliest opportunity. A General Committee Member declaring such an interest must absent himself from the General Committee meeting during discussion of and decision about that item unless given permission to remain.

DRESS CODE AND FUNCTIONS
General Committee Members should be appropriately dressed for new member interviews and disciplinary hearings. General Committee members should show a good example to other members by participating in club functions where possible.
